  • Overview

    The incumbents[s] within this classification will work on all but the most complex cases and legal assignments.  The attorneys in this classification will provide legal representation on behalf of the company and its’ policyholders in workers’ compensation proceedings before the California Workers’ Compensation Appeals Board.  The attorney also provides case management legal advice and assistance primarily to claims adjusters and other teams on issues relating to workers’ compensation law and procedure.


    The attorneys within this classification will work within the guidelines of established office policies, Workers’ Compensation Appeals Board procedures, and applicable rules of court.  Their work may be reviewed by a Senior Attorney and/or Legal Manager to ensure quality control along stated office guidelines and policy.  The incumbent[s] in this classification will review claims files, identify legal issues and conduct discovery in preparation for the hearings before the Workers’ Compensation Appeals Board.  This preparation includes taking depositions, scheduling agreed medical examinations, conferring with claims adjusters, policyholders and physicians.  The attorney will also participate in settlement negotiations, draft legal motions and memoranda, interview witnesses, and participate in mediation conferences.  The attorney must comply with legal filing deadlines on all cases. 


    Non-litigation duties include providing daily advice and counsel to claims adjusters.


    The attorney in this classification may speak at professional functions, seminars, etc. on workers’ compensation topics.


    The incumbent[s]  will also peform various special legal project tasks for the Legal Manager or Chief Counsel.


    This position requires extensive travel to the various Workers’ Compensation Appeals Board district offices, as well as various attorney and doctor offices for depositions.



    Intermediate knowledge of workers’ compensation law, Workers’ Compensation Appeals Board procedure and appellate procedure.


    Intermediate to senior litigation skills in the following areas:  discovery, courtroom advocacy, verbal and written legal communication, settlement negotiations and document preparation.


    Intermediate to senior skills in the areas of research and writing, oral advocacy, client advice, problem solving and organizational awareness.


    Intermediate to senior interpersonal and customer service skills to represent the company as a professional attorney and business advocate.


    The attorney must maintain good standing with the California State Bar.



    The attorney must maintain good standing with the California State Bar.


    Intermediate to senior level legal communication skills both verbally and in written form to draft legal motions, and memoranda relating to assigned case work.


    Required education is a bachelors degree and juris doctor degree from accredited college of law; admitted to State Bar of California.  Minimum 3 years experience as an attorney practicing Workers’ Compensation Law in California.
